Christine Baumgartner -the estranged wife of Kevin Costner who has allegedly refused to leave the Yellowstone actor home has put a stop to their divorce procedures.
Costner said Baumgartner has not left his home in southern California despite a provision in their prenuptial agreement requiring her to do so, which received the court paperwork submitted last Friday. The arrangement, which was inked when the couple were married in 2004, according to Costner, 68, gives Baumgartner 30 days to vacate the home after filing for divorce.
The 30-day window has gone since Baumgartner, 49, filed for divorce on May 1. She described the reason for the divorce as “irreconcilable differences”.
Costner contended that the prenuptial agreement granted him sole ownership and use of his separate property dwellings in the event of divorce in the most recent court filing.
He claimed Baumgartner kept the house unoccupied in an effort to pressure Costner into satisfying “various financial demands.” The specifics of the monetary requirements are unclear.
“Christine’s agreement to move out was and is unconditional. Indeed, independent of the PMA (pre-marital agreement) she has no right to occupy Kevin’s separate property residence,” the memorandum reads, according to Fox News. “Kevin has acted in good faith and had done everything in his power to make the transition as seamless as possible.”
Costner continued by saying that as part of the prenuptial agreement, he had already handed Baumgartner US$1.2 million (about CA$1.6 million). The actor said that he is ready to contribute a $200,000 ($264,560) down payment for Baumgartner’s new home. According to a separate TMZ article, Costner offered an additional $30,000 (almost $39,680) for monthly rent fees in addition to $10,000 (about $13,230) for moving expenses.
The actor also stated that he had drafted a temporary child support proposal and that he had covered part of Baumgartner’s legal and accounting bills. According to Costner’s attorneys, he has agreed to keep Baumgartner’s financial situation the same and will cover all of the costs for their three children, Cayden, 15, Hayes, 14, and Grace, 12, who they had together.
Neither Costner and Baumgartner have commented publicly on the memorandum.
